PUBLIC NOTICE

    Pursuant to 25 CFR §151.12(b) this provides notice that a final agency determination by the Southern Pueblos Agency, Bureau of Indian Affairs, Albuquerque, New Mexico, has been made to approve a fee-to-trust land acquisition for the Pueblo of Acoma.  Pursuant to this action, the property described below will be placed in trust status for the Pueblo of Acoma, under the administrative jurisdiction of the Southern Pueblos Agency, Bureau of Indian Affairs, U. S. Department of the Interior.


    All of the following described tracts of land comprising a total area of 204.86 acres, more or less, consisting of TRACTS A, B, C, and D, as shown on the Plat designated Attachment 1 to Exhibit A and as described below, situated within Sections 22 and 23, Township 10 North, Range 7 West, New Mexico Principal Meridian, Cibola County, New Mexico and being more particularly described as follows:

    TRACT A

    A certain tract of land situated within the East one-half of Section 22 and the West one-half of Section 23, Township 10 North, Range 7 West, New Mexico Principal Meridian, Cibola County, New Mexico, containing 164.97 acres, more or less, officially designated Tract A, Township 10 North, Range 7 West, New Mexico Principal Meridian, New Mexico, as surveyed in 2003 by the U.S. Department of the Interior, Bureau of Land Management, Cadastral Survey, and shown on the official plat of survey and described in the official field note record, both approved May 19, 2004, and filed in the records of the Bureau of Land Management, New Mexico State Office, in Santa Fe, New Mexico.

    (Note:  The Plat of Survey prepared by Fred D. Marmon, New Mexico Registered Professional Land Surveyor (RPLS) No. 2031, titled “Plat of Survey, Tract A,B,C,and D, Sections 22 and 23, T. 10 N., R.7W., N.M.P.M., Cibola County, New Mexico,” dated March 15, 1997, and recorded in the Office of the County Clerk of Cibola County, New Mexico, At Book 6, Page 5233 on July 30, 1997, shows a tie of N. 30˚ 15'00'' E., 955.33 feet distance from the northwest corner of Tract A [identified as Angle Point No. 1, Tract A, in the above-described official Bureau of Land Management Cadastral Survey records] to the corner of Sections 14, 15, 22, and 23 T. 10 N., R. 7.W., N.M.P.M.. labeled “Marked Stone.”)

    TRACT B

    A certain tract of land situated within the West one-half of Section 23, Township 10 North, Range 7 West, New Mexico Principal Meridian, Cibola County, New Mexico, containing 6.20 acres, more or less, officially designated Tract B, Township 10 North, Range 7 West, New Mexico Principal Meridian, as surveyed in 2003 by the U.S. Department of the Interior, Bureau of Land Management, Cadastral Survey, and shown on the official plat of survey and described in the official field note record, both approved May 19, 2004, and filed in the records of the Bureau of Land Management, New Mexico State Office, in Santa Fe, New Mexico.

    TRACT C

    A certain tract of land situated within the West one-half of Section 23, Township 10 North, Range 7 West, New Mexico Principal Meridian, Cibola County, New Mexico, containing 3.62 acres, more or less, officially designated Tract C, Township 10 North, Range 7 West, New Mexico Principal Meridian, as surveyed in 2003 by the U.S. Department of the Interior, Bureau of Land Management, Cadastral Survey, and shown on the official plat of survey and described in the official field note record, both approved May 19, 2004, and filed in the records of the Bureau of Land Management, New Mexico State Office, in Santa Fe, New Mexico.

    TRACT D

    A certain tract of land situated within the West one-half of Section 23, Township10 North Range 7 West, New Mexico Principal Meridian, Cibola County, New Mexico, containing 30.07 acres, more or less, officially designated Tract D, Township 10 North, Range 7 West, New Mexico Principal Meridian, as surveyed in 2003 by the U.S. Department of the Interior, Bureau of Land Management, Cadastral Survey, and shown on the official plat of survey and described in the official field note record, both approved May 19, 2004, and filed in the records of the Bureau of Land Management, New Mexico State Office, in Santa Fe, New Mexico.

    SUBJECT TO  Powerline Easement as shown in Tract A, on the Plat of Survey prepared by Fred D. Marmon, New Mexico RPLS No. 2031, and recorded in the Office of the County Clerk of Cibola County, New Mexico, at Book 6, Page 5233, on July 30, 1997; and,

    SUBJECT TO Powerline Easement and Overhead Telephone Line Easement as shown in Tract C, on the Plat of Survey prepared by Fred D. Marmon, New Mexico RPLS No. 2031, and recorded in the Office of the County Clerk of Cibola County, New Mexico, at Book 6, Page 5233, on July 30, 1997; and,

    SUBJECT TO Overhead Telephone Line Easement and Transwestern Pipeline Easements dated March 26, 1959, and December 18, 1968, as shown in Tract D, on the

    Plat of Survey prepared by Fred D. Marmon, New Mexico RPLS No. 2031, and recorded in the Office of the County Clerk of Cibola County, New Mexico, at Book 6, Page 5233, on July 30, 1997; and
