FORECLOSURE SALE
Notice is hereby given that Michael J. Caplan, Special Master, will on February 25, 2010, at 10:00 a.m. at the West entrance of the Administrative Office Entrance of the Cibola County District Court, on Iron Street, Grants, New Mexico 87020, sell and convey to the highest bidder for cash all right, title and interest of Defendants Bob Hinkle; Hinkle Properties, Inc., HIG Enterprises, LLC, FD-RE, LLC, TT McLoud-RE, LLC, Hinkle Services, Inc. FD-Heavener, LLC, HSI McLoud, LLC, Texas HSI One, LLC, Texas HSI Two, HIS One, LLC, Family Dollar Stores of New Mexico, in and to the following described the Real Property is located in Cibola County New Mexico and more particularly described as follows:
Lots 1, 2, 3, 4, 5, 6 and 21 in Block 6 of Milan Townsite, Cibola County, New Mexico; also known as 805 West Highway - 66 (hereinafter referred to as the "Property").
With a common address of 805 West Highway 66, Milan, N.M. 87021.
The sale will be made pursuant to the Order of Judgment by Default and Foreclosure entered on January 19, 2010 which resulted from a suit to foreclose certain Notes, Loan Agreement and Mortgages held by Plaintiff and wherein Plaintiff was adjudged to have a valid lien on the Real Property superior to all other claims and was awarded judgment on the Notes an in rem in the amount of Two Million Four Hundred Thirty Nine Thousand Five Hundred Eleven and 23/100 Dollars ($2,439,511.23) plus accrued interest as set forth in the Notes described in the Complaint, plus costs and fees to which Plaintiff is entitled under the Notes and Loan Agreement described in the Complaint (the “Judgment”) plus post judgment interest as provided by law, and the costs of this suit, including Special Master's fees, the cost of publication, costs of sale and for such other expenses, if any, such as taxes as may be incurred by Plaintiff, plus interest thereon as provided in the Mortgages and Notes.
The expenses of sale and fee of the Special Master shall be deducted from the sale proceeds before any satisfaction of judgment. Any party bidding its judgment, or any part thereof, may submit its bid to the Special Master, either orally or in writing, prior to the sale. All bids must be for cash or funds in a form acceptable to the plaintiff and must be paid by 5:00 p.m. on the day of the sale. Plaintiff may bid at the sale and may apply all or any part of its judgment to the purchase price in lieu of cash. The sale may be postponed and rescheduled at the discretion of the Special Master.
The Mortgage is being foreclosed subject to the Mortgage, Security Agreement, Fixture Filing and Statement (hereafter, the “Mortgage”), which was filed with the Clerk of Cibola County on October 22, 2007 as document No. 200703674.
